Terms & Conditions for Participating in the Eye on the Strand Photo Contest

Before submitting an entry, carefully read the following terms and conditions of use.

Sponsors are the Strand Book Store, the Aperture Foundation and the Pratt Institute for Continuing & Professional Studies.

Terms

The Eye on the Strand Photo Contest will begin on November 7, 2008 at midnight (12:00AM) US Eastern Standard Time and ends Tuesday, March 31, 2009 at 11:59PM US Eastern Standard Time (the “Contest”). Information on how to enter and prizes form part of these official rules (“Official Rules”). By submitting an entry, each entrant agrees to the Official Rules and warrants that his or her entry complies with all requirements set out in the Official Rules. This is a skill based contest and chance plays no part in the determination of the winners.

Who May Enter

Contest is open to all, aged 18 years and above. Employees of the Strand Book Store, the Aperture Foundation and the Pratt Institute, or members of their respective families, are only eligible to participate in the Employee Category. The Contest is void where prohibited.

How to Enter

No purchase is necessary and a purchase will not increase your chances of winning. To enter, visit the contest entry page, complete an entry form with the required information, including your name, email address, city, state, country, age, personal web url (optional), job title (optional) and photo caption (optional) and submit along with your photograph in accordance with the instructions below. We will not accept photos via email.

The Categories

(1) Black & White and (2) Color. Each entrant may submit his/her photographs into whichever category he/she wishes. Entrants are permitted to submit a maximum of THREE (3) photographs in the Photo Contest. If an entrant exceeds this limit, Sponsor may at its sole discretion disqualify the entrant. An entry is defined in the following paragraph, “Requirements”

Requirements

Each entry must comply with the following requirements (the “Photograph Requirements”): Photographs must be in digital format. Only online entries will be eligible. No print or film submissions will be accepted for entry into this Contest. The photograph need not be taken with a digital camera; scans of negatives, transparencies or photographic prints are acceptable. All digital files must be 2 megabytes or smaller, must be in JPEG of .jpg format and must be at least 1,600 pixels wide (if a horizontal image) or 1,600 pixels tall (if a vertical image). Hi-resolution images must be available upon request for printing purposes.

Photographs must not have been previously published.

Photographs that include other works of art will be accepted as long as they do not constitute copyright infringement or fraud; provided that entrants must be prepared to provide a release form as described below in “Release.” When photographing the work of others, it must be as an object in its environment and not a full-frame close up of another person’s art.

The photograph, in its entirety, must be a single work of original material taken by the Contest entrant. By entering the Contest, entrant represents, acknowledges and warrants that the submitted photograph is an original work created solely by the entrant, that the photograph does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, and that no other party has any right, title, claim or interest in the photograph.

Judging

Images will be judged on overall photographic and artistic quality and how they best and most creatively represent the Strand Book Store. Decision of judges will be final.

Permission to Shoot at the Strand

To be permitted to shoot in the store, mention that you are shooting for the Strand Photo Contest. In-store photographers must cooperate with the store staff. Photographers may only use hand-held cameras; no tripods, lighting, other equipment will be permitted. Strand Book Store reserves the right to refuse or dismiss any photographer at its sole discretion.

Disclaimer

The Strand Book Store is a family-friendly store and website. We reserve the right to reject any photograph at our sole discretion, including but not limited to pornographic or violent images.

Photographs must represent the Strand Book Store.

Public Viewing & Granting of Limited Rights

Be aware that, if chosen, your photograph will be displayed to the public. Your image will be included on the Strand Book Store websites, in the store and possibly in other marketing materials for the Strand Book Store

By participating in this contest, you are allowing Strand Book Store to publish the photograph on, including but not limited to, the Strand web sites, and other electronic and print promotional materials and in print media, all with photo credit.

Copyright

Copyright of the image remains the property of the photographer. A photo credit with copyright symbol will be provided with your image. All images must be originals and must belong to the person submitting the photograph; all rights in the photograph must be the property of the person submitting the photograph.

Model and Property Release

Contestant acknowledges that they have sufficient written permission of any recognizable locations or people appearing in the photograph to be able to grant to Strand Book Store the right to publish their photographic submission online and in print, and hereby grant to Strand Book Store such right. The content of a photograph is defined as a combination of subject, point of view, as well as digital interpretation via Photoshop or another image editing program. Before being awarded their prize, contest winners will be required to sign a legal affidavit indicating that they are in fact the photographer who created the photograph, that they own legal copyright, and that they have written releases for any recognizable locations (except the Strand Book Store or Strand’s Central Park Kiosks) and people appearing in the photograph. Strand Book Store will attempt to contact prize winners by email. If the winner does not respond to our email and claim the prize within 10 days, the prize will be forfeited. Winners are responsible for all applicable federal, state or local taxes, tariffs or import duty fees. This contest is governed by the laws of the State of New York, USA. Additionally, if local laws in your place of residence make this contest illegal, do not enter the contest.

  • A collection of fifty Aperture photography books (value: over $2,000)

  • Photo exhibited on Strand’s online Photo Gallery

Second Prize:

  • Free photography or computer graphics course at Pratt CCPS * (value $805)
  • A collection of fifty Aperture photography books (value: over $2,000)
  • One-year subscription to Aperture magazine
  • Photo exhibited at Pratt CCPS Gallery (July 2009)
  • Photo exhibited on Strand’s online Photo Gallery

Third Prize:

  • $300 B&H Photo Gift Card
  • $250 J. Crew Gift Card & personal styling consultation at J.Crew’s new Tribeca men’s shop
  • One-year subscription to Aperture magazine
  • Photo exhibited at Pratt CCPS Gallery (July 2009)
  • Photo exhibited on Strand’s online Photo Gallery

*The Pratt Institute course is non-transferable and must be redeemed within 2 years of receipt.

20 finalists will receive a $25 Strand gift card, a Strand tote bag, placement at the Pratt Gallery’s photo exhibition in July 2009 and placement on the Strand’s online photo gallery.

Viewers Choice Award

The public will be able to view all photographs submitted to the contest and will be able to vote for their favorite. The winner of the Viewers Choice Award will have his/her photograph featured on the Strand online gallery and will receive a Strand gift card.
